Agreement to Terms

These Terms of Service are an agreement between you and recint ("we," "us"). By accessing this website or using the recint application, you agree to be bound by them and by our Privacy Policy. If you do not agree, do not use our services.

Description of Service

recint is a mobile application for iOS for discovering, organizing, and sharing fashion. The service is currently available only through our private beta program. Access to the beta is granted at our discretion, is personal to you, and may be modified or revoked at any time.

Beta Terms

The beta is a pre-release version of recint. In addition to the disclaimers below:

• Features may change, break, or be removed without notice, and your data may be reset between beta builds.
• Beta access is distributed through Apple TestFlight and is also subject to Apple's TestFlight terms.
• If you send us feedback, ideas, or suggestions about recint, you grant us a perpetual, irrevocable, royalty-free license to use them without restriction or obligation to you.

Eligibility

You must be at least 13 years old to use recint. If you are under 18, you represent that your parent or guardian has reviewed and agreed to these terms on your behalf. The application is designed for use on Apple iOS devices only.

User Accounts

When you create an account, you agree to provide accurate information and keep it current. You are responsible for safeguarding your account credentials and for all activity under your account. Notify us immediately at contact@recint.com if you believe your account has been compromised. We may reclaim usernames that are inactive, misleading, or infringe someone else's rights.

Acceptable Use

You agree not to use recint to:

• Upload content that infringes intellectual property or other proprietary rights;
• Harass, abuse, threaten, or harm other users;
• Impersonate any person or misrepresent your affiliation with anyone;
• Distribute spam, malware, or other harmful or deceptive content;
• Attempt to gain unauthorized access to our systems or other users' accounts;
• Probe, scan, or test the vulnerability of the service, or circumvent its security or rate limits;
• Use automated tools to scrape, index, or collect data from the service, including for training machine-learning models;
• Violate any applicable laws or regulations.

We may remove content or restrict accounts that violate these rules.

User Content

You retain ownership of content you upload to recint. By uploading content, you grant us a non-exclusive, worldwide, royalty-free, sublicensable license to host, use, display, reproduce, and distribute that content solely in connection with operating, providing, and improving the service. This license ends when you delete the content or your account, except where the content has been shared with others and they have not deleted it, or where we are required to retain it by law. You represent that you have the rights necessary to grant this license.

Copyright Complaints

We respect intellectual property rights. If you believe content on recint infringes your copyright, send a notice to contact@recint.com including: identification of the copyrighted work, the location of the allegedly infringing material, your contact information, a statement of good-faith belief that the use is unauthorized, and a statement, under penalty of perjury, that the information is accurate and you are authorized to act for the rights holder. We may remove content and terminate the accounts of repeat infringers.

Intellectual Property

The recint name, logo, application, and website design are our property and are protected by intellectual property laws. Except for the limited right to use the service as intended, no license to our materials is granted. You may not copy, modify, or create derivative works from them without our prior written permission.

Third-Party Content & Services

recint may display content from third parties, including fashion items, brands, and retailers, and may link to third-party sites. We do not control and are not responsible for third-party content, and its appearance in recint is not an endorsement. Any transaction with a third party — including any purchase of an item you discover through recint — is solely between you and that party.

Apple-Specific Terms

Because recint is distributed through Apple platforms: these terms are between you and recint, not Apple; Apple has no obligation to provide maintenance or support for the app; Apple is not responsible for addressing any claims relating to the app, including product liability, legal compliance, or intellectual property claims; and Apple and its subsidiaries are third-party beneficiaries of these terms, entitled to enforce them against you. You represent that you are not located in a country subject to a U.S. government embargo and are not on any U.S. government list of prohibited or restricted parties.

Disclaimers

The service is provided on an "as is" and "as available" basis, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the service will be uninterrupted, secure, or error-free, or that content will be accurate or preserved. Beta features may change or be discontinued without notice.

Limitation of Liability

To the maximum extent permitted by law, recint shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from or related to your use of the service, even if we have been advised of the possibility of such damages. Our total liability for all claims shall not exceed the greater of fifty U.S. dollars (US$50) or the amount you paid us in the twelve months preceding the claim. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

Indemnification

You agree to indemnify and hold recint harmless from claims, damages, and expenses (including reasonable attorneys' fees) arising from your content, your use of the service, or your violation of these terms or of any third party's rights.

Changes to Terms

We may update these terms at any time. If a change is material, we will notify you through the application or by email before it takes effect. Continued use of the service after changes take effect constitutes acceptance of the revised terms. If you do not agree to the revised terms, stop using the service.

Termination

You may stop using recint and delete your account at any time. We may suspend or terminate your access at any time, with or without cause, including for violation of these terms. Upon termination, your right to use the service ends immediately. Provisions that by their nature should survive — including User Content license (as limited therein), Disclaimers, Limitation of Liability, Indemnification, and Governing Law — remain in effect.

Governing Law

These terms are governed by the laws of the State of California, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in Los Angeles County, California, and you consent to their jurisdiction.

Miscellaneous

These terms, together with the Privacy Policy, are the entire agreement between you and recint regarding the service. If any provision is found unenforceable, the rest remain in effect. Our failure to enforce a provision is not a waiver of it. You may not assign these terms; we may assign them in connection with a merger, acquisition, or sale of assets.
